JIVELIVE – TERMS & CONDITIONS

These Terms & Conditions (“Terms”) form a binding legal agreement between you (“User”, “you”, “your”) and JiveLive (“Company”, “we”, “us”, “our”). By creating an account, accessing the platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Community Guidelines, and any additional policies referenced herein.

If you do not agree to these Terms, you must stop using the platform immediately.


1. DEFINITIONS

For the purposes of this Agreement:

  • “Platform” means JiveLive, including the website, mobile applications, APIs, and related technology.

  • “User” refers to any individual accessing the platform, including viewers, subscribers, and creators.

  • “Creator” refers to a User who publishes and monetizes content on the platform.

  • “Subscriber” refers to a User who pays to access creator content or features.

  • “Content” means any photos, videos, text, audio, posts, or materials uploaded by Users.

  • “Services” means all functions, tools, and features provided by JiveLive.

  • “Payment Processor” refers to third-party services such as Stripe or PayPal that handle financial transactions.

  • “Subscription” means a recurring payment that grants access to exclusive creator content.

  • “Tips” means voluntary one-time payments made to creators.

  • “Paid Posts” means content unlocked by a one-time fee.


2. ELIGIBILITY

To use JiveLive, you must:

  1. Be of legal age in your jurisdiction.

  2. Provide accurate, truthful information.

  3. Not be barred from using digital platforms by any applicable laws.

  4. Not have been previously removed from JiveLive for violation of policies.

  5. Comply with all local, national, and international laws.

Creators may be required to submit additional verification documents (ID, bank details, compliance documents).


3. ACCOUNT REGISTRATION

3.1 Account Creation
Users must register an account using a valid email address and password. All information must be truthful and kept up-to-date.

3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials. Any activity under your account is considered your responsibility.

3.3 Unauthorized Access
If you suspect unauthorized account use, you must notify us immediately at:

We reserve the right to suspend or terminate accounts involved in unauthorized access or suspected fraud.


4. CONTENT OWNERSHIP & LICENSE

4.1 You Retain Ownership
Creators retain full copyright and ownership over all content they upload.

4.2 License to JiveLive
By uploading content, you grant JiveLive a limited, non-exclusive, worldwide, royalty-free license to:

  • Store your content

  • Display your content to subscribers

  • Process, transmit, and deliver your content via the platform

  • Use your content solely for platform functionality

This license is revocable when you delete your content or account.

4.3 No External Use
JiveLive does not claim ownership, resell, license, or distribute your content outside the platform.

4.4 Content Removal
We reserve the right to remove content that violates our Terms or Guidelines.


5. USER OBLIGATIONS

Users agree to:

  • Follow all platform rules

  • Respect the rights of other users

  • Not engage in harassment, abuse, or hate speech

  • Not upload harmful, illegal, or deceptive content

  • Not attempt to hack, reverse engineer, or interfere with the platform

  • Not impersonate others or misrepresent their identity

  • Use payment methods lawfully and legitimately


6. PROHIBITED CONDUCT

Users may NOT:

  1. Upload illegal materials

  2. Engage in fraud or financial manipulation

  3. Harass, threaten, or dox other users

  4. Upload malware, viruses, or harmful scripts

  5. Circumvent paywalls or distribute paid content

  6. Use bots or automated tools without permission

  7. Create multiple accounts for malicious purposes

  8. Post misleading, harmful, or deceptive information

Violation may result in immediate account termination.


7. SUBSCRIPTIONS, PAYMENTS & FEES

7.1 Subscription Charges
Subscription fees are billed automatically on a recurring basis until canceled.

7.2 Payment Processing
Payments are processed through third-party providers (e.g., Stripe, PayPal).
You agree to their terms in addition to ours.

7.3 Refunds
Digital purchases are generally non-refundable, except where required by law or approved by JiveLive after review.

7.4 Chargebacks
Unauthorized chargebacks may result in:

  • Account suspension

  • Loss of purchased content

  • Fees charged to your account

7.5 Creator Pricing
Creators may set their own subscription pricing within platform limits.

7.6 Platform Fees
JiveLive deducts a fee from payments made to creators to cover platform operations, security, and payment processing costs.


8. CREATOR EARNINGS & WITHDRAWALS

8.1 Earning Sources
Creators can earn from:

  • Subscriptions

  • Tips

  • Paid Posts

8.2 Withdrawal Methods
Withdrawals are available via:

  • PayPal

  • Bank Transfer

  • Any other method enabled by the administrator

8.3 Withdrawal Requirements
Creators must:

  • Meet the minimum earnings threshold

  • Provide correct payout information

  • Comply with local tax laws

  • Pass any required verification

8.4 Withdrawal Processing
Withdrawals are manually reviewed for fraud prevention and may take several business days.

8.5 Taxes
Creators are solely responsible for reporting and paying their taxes.


9. CONTENT MODERATION

To protect users and comply with the law, JiveLive may:

  • Review content

  • Remove content that violates policies

  • Suspend or terminate accounts

  • Limit features temporarily

  • Report illegal activity to authorities


10. REPORTING & SAFETY

10.1 Reporting a User
Users may report content or accounts directly through the platform’s reporting tools.

10.2 Blocking
Users may block others from messaging or viewing their profile.

10.3 Safety Policy
We aim to maintain a respectful, safe environment for all users. Violations may be handled with warnings, suspensions, or permanent bans.


11. PRIVACY & DATA PROTECTION

11.1 Data Collection
We collect data necessary for platform operations.
This includes:

  • Account information

  • Payment-related information (processed via third parties)

  • Device and usage data

11.2 Data Protection
We use encryption, secure servers, and industry-standard protocols to protect user data.

11.3 Payment Information
We do not store full credit/debit card data. Payment processors handle all sensitive payment information.

12. SERVICE AVAILABILITY

12.1 No Guarantee of Continuous Access
We strive to keep the platform available at all times, but we do not guarantee:

  • Uninterrupted access

  • Error-free functionality

  • Permanent retention of content

12.2 Maintenance
Scheduled or emergency maintenance may temporarily affect access.

12.3 Changes to Features
We may modify, add, or remove features without notice.


13. ACCOUNT TERMINATION

We reserve the right to:

  • Suspend accounts

  • Remove content

  • Terminate accounts

Reasons include:

  • Violation of Terms

  • Fraud or suspicious activity

  • Safety risks

  • Legal compliance

Users may also delete their own account at any time.

Upon termination:

  • Access to content is revoked

  • Pending earnings may be withheld if related to violations

  • Data may be retained for fraud prevention or legal requirements


14. DISCLAIMERS

YOU AGREE THAT:

  • The platform is provided “as is” and “as available.”

  • We perform no guarantee that content will generate income.

  • We are not responsible for user-to-user interactions.

  • We do not guarantee uptime or continuous service availability.

  • We disclaim all warranties, express or implied, including fitness for a particular purpose.


15. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • JiveLive is not liable for direct, indirect, incidental, or consequential damages arising from use of the platform.

  • Our total liability to any user shall not exceed:
    The total amount paid by that user to JiveLive in the previous 12 months,
    or $100 USD, whichever is lower.

You agree that JiveLive is not responsible for:

  • Loss of data

  • Loss of income

  • Disruptions, errors, or outages

  • Actions of other users

  • Third-party payment processors


16. INDEMNIFICATION

You agree to indemnify and hold harmless JiveLive, its officers, directors, employees, and partners from any claim, damage, loss, or expense arising from:

  • Your use of the platform

  • Your uploaded content

  • Your violation of any law or these Terms

  • Your interactions with other users


17. GOVERNING LAW

These Terms are governed by the laws of Hong Kong .

Any disputes shall be resolved by courts or arbitration panels in the chosen jurisdiction.


18. CHANGES TO TERMS

We may update or amend these Terms at any time.
You will be notified of material changes via email or platform notifications.

Continued use of JiveLive after changes means you accept the updated Terms.
